Overview

Welcome to the website of our company. The sales and services e-shop (from now on the “e-shop”) operates under the trade name MIND PROJECT SINGLE MEMBER P.C. (from now on and for reasons of brevity the “COMPANY”), which is based in the Municipality of Heraklion, Crete, Greece, and is legally represented, with the following particulars: General Commercial Register No. 149912321000, TIN EL800965893 — Fiscal Service: Heraklion. Through the e-shop, the COMPANY provides directly to consumers in Greece and abroad wooden items, desks, houses, and all types of products and care equipment for dogs and other pets, manufactured by it or by third cooperating companies. Each User entering the site and performing transactions or using the e-shop services is considered to consent and accept without reservations the terms expressed herein, without any exceptions. If a User does not agree with these terms, they are required to refrain from the use of the e-shop and from any transactions through it.

General Terms

The COMPANY may, at its absolute discretion, proceed to the amendment of the present Terms of Use without prior notification, and assumes the obligation to inform consumers on any change through the update of this page, especially the section concerning the present terms of use. The COMPANY shall post the relevant applicable version of the terms of use, while continuation of the use of the application shall mean unreserved acceptance of such terms by the visitor. Each user is required to check at regular intervals the terms of use. In case of total or partial invalidity of individual terms, this shall not affect the validity of all the remaining terms.

Information and Products

The COMPANY is committed to the truth, accuracy and completeness of the information provided in the e-shop, with regard to the identity and details of both the COMPANY and its suppliers, as well as the essential characteristics of the products or services provided through the e-shop. The COMPANY reserves its rights and does not accept any liability for technical or typographic mistakes accidentally made, or caused by force majeure, which will be corrected when they become known.

Limitation of Liability

The COMPANY shall fully comply with the provisions of Greek law and particularly the Civil Proceedings Code concerning the sale of mobile goods and the provisions of Law no. 2251/1994 on Consumer Protection, as in effect. In the context of its transactions through the e-shop, the COMPANY shall notify the User on the basis of the data kept at the time regarding the availability or non-availability of the products, and shall in no case guarantee availability thereof. In any case, the COMPANY undertakes to notify the User in due time on the non-availability, in which case it does not bear any further liability. The order may be partially accepted and executed; the COMPANY undertakes the obligation for damages that may arise from the non-acceptance or non-execution of all or part of an order.

The COMPANY shall try to provide high quality services on a daily basis. In the context of good faith, it shall not be liable for faults in the characteristics, photographs and product prices listed on the site, if it was not able to ensure that there are no such faults during input and update of the characteristics or the price of a product. The COMPANY is only liable for gross negligence and fraud in case of delay in the delivery of ordered products, and generally for errors and information that it provides to its customers through its website.

The COMPANY does not bear any responsibility for any unauthorized interventions of third parties to products or services or information made available through the e-shop, nor for any technical problems that may occur to users when attempting to access the website, that are related to the operation or compatibility of their own infrastructure or to technical problems of the internet provider.

User Liability

Each User/customer is required to use the services, the information and the data of the e-shop as provided by the law and according to the principles of good faith and transaction ethics. Before accessing and using the e-shop, each User must read carefully and ensure that they have understood and agree with the said terms, statements and conditions, as further use and navigation on the website implies express and unreserved consent to and acceptance thereof.

In particular, when completing online communication forms, the User must provide accurate and complete information (name, address, message, etc.). Users undertake not to allow usage of their data and access passwords by minors or persons that do not have the ability to perform transactions, and are responsible for any incident that may occur by third parties using the site through their credentials. Users agree not to use the e-shop for transmission or publication of content that is illegal, offensive, defamatory, or that violates intellectual property or privacy rights of third parties.

Governing Law & Dispute Resolution

Contracts through our e-shop are governed by European and Greek law, in particular by legislation governing issues related to e-commerce, distance selling and consumer protection. For any dispute that arises from the contractual relationship between the COMPANY and the customer, the Courts of Heraklion, Crete are competent for its resolution. For the out-of-court settlement of disputes, the customer can address the competent bodies for out-of-court settlement of consumer disputes, i.e. the General Secretariat for Consumer Affairs of the Ministry of Development and Competitiveness, and the Consumer Ombudsman (www.synigoroskatanaloti.gr).

According to Directive 2013/11/EC, disputes can also be resolved through the electronic settlement of consumer disputes with the Alternative Dispute Resolution procedure throughout the European Union via the platform webgate.ec.europa.eu/odr.
